The Supreme Court of Victoria has ordered that Maddens Lawyers distribute the Opt Out Notice to persons who may be eligible group members in the Toyota Diesel Emissions Class Action.

If you received a copy of the Opt Out Notice by email or SMS, this is because the you may be a group member in the Toyota Diesel Emissions Class Action. To check your eligibility, please read the information here: "Are you a group member?"

 

What is “Enterclaim”?

Maddens Lawyers have engaged a third party to distribute the Opt Out Notice to all potential group members in the proceeding. As a result, you may have received an email from the following address toyotadiesel@enterclaim.com or a SMS from “EnterClaim”.

The Opt Out Notice is also distributed across social media platforms to notify potential group members that may not have received an email or SMS directly.

You should read the Opt Out Notice carefully and if there is anything that you do not understand, we recommend that you continue reading the information on this webpage or seek your own legal advice.

 

What is Opt Out?

If you do not wish to remain a Group Member in the Toyota Diesel Emissions Class Action, you can opt out. This means that you will not participate in the class action. If you opt out, you will not be included in any compensation or award the Court makes or any settlement. If you opt out, you can still bring your own claim against Toyota. However, you should seek your own legal advice about doing so and about any time limits that may apply.

If you do not wish to remain a Group Member you must opt out of the class action by 4pm (AEDT) on 16 July 2026.

Why would a group member Opt Out?

A group member may not want their rights determined by the Toyota Diesel Emissions Class Action and may choose to opt out.

If a group member opt outs of the class action, they will no longer be a group member, and will not be entitled to any compensation arising from any settlement or award of damages in the Toyota Diesel Emissions Class Action.

If a group member does not opt out by 4pm (AEDT) on Thursday 16 July 2026, they will remain a group member and be bound by any settlement or judgement in the class action.

 

Opt Out Deadline

Group members who wish to opt out will need to complete the Notice of Opting Out by Group Member by 4pm (AEDT) on Thursday 16 July 2026.

Alternatively, a group member can complete the NOTICE OF OPTING OUT BY GROUP MEMBER and return a copy to toyotadieselclassaction@supcourt.vic.gov.au or post to:

Do you want to remain a group member?

If you want to remain a group member in the Toyota Diesel Emissions Class Action, you can:

  1. You can register to participate in the class action. You will remain a Group Member and receive ongoing updates about the class action and any mediation or proposed settlement. Register here.
  1. DO NOTHING. If you do nothing, you will remain a Group Member.
